Every drunk driving charge varies a lot by county, the specific situation, and the past record of the accused. Since a DWI conviction cannot be expunged, it is essential to defeat the charge or plea to a different charge. After two drunk driving convictions, you are looking at a felony DWI for your third.

Main DWI Defense: The first thing we attack is reasonable suspicion to pull the car over or probable cause to make the arrest. We also look for the failure to conduct breath and blood tests in accordance with Texas standards and with NTSA standards. All field tests must comply with NTSA standards or they are invalid. From toxicology evidence weakness to video evidence at odds with police report or testimony, there are a number of ways to build a strong defense.
Plea to a Non-alcohol Offense: If we are able to reduce your charge to a non-alcohol offense, such as obstruction of roadway, you could receive deferred adjudication. This can lead to a petition for nondisclosure of the record.
If you have been arrested for drunk driving, you will have fifteen days after your arrest to request an Administrative License Revocation (ALR) hearing. We will use the following ALR hearing as a way to perform discovery and commit the arresting officer to a story that may not hold up at trial. This is especially effective in BAC and refusal cases and the evidence gathered can be used later at your DWI trial.
