What Are the Penalties for Underage DWI?
If you’re between 17 and 20 years old and have a BAC of 0.08 or higher, you will face an underage DWI charge and the following penalties:
- Up to $2,000 in fines
- A license suspension from 3 months to 1 year
- 3 to 180 days in jail
Note that the penalties will increase for every additional offense.
If someone over 21 has a BAC of 0.08 or higher, the arresting officer may charge them with a DWI or DUI. It’s their choice.
Penalties for DUI
If you are under 21 and have any detectable traces of alcohol in your system, you may be charged with drinking and driving. The Texas Department of Transportation (TxDOT) says that you could face these penalties if it’s your first alleged offense:
- Up to $500 in fines
- 20 to 40 hours of community services
- A 60-day license suspension
- Mandatory alcohol-awareness classes
What Are the Differences Between a DWI and a DUI?
Driving under the influence (DUI), DWI, and underage DWI are offenses that have to do with driving under the influence of drugs or alcohol. Many people use these terms interchangeably, but there are some key differences.
- DUI: Those under 21 who have any detectable amount of alcohol in their system may receive this charge, as Texas has a zero-tolerance policy for underage drinking. A DUI is a much less serious charge.
- DWI: Those who have a blood alcohol concentration (BAC) of 0.08 or more or who cannot use their mental or physical faculties may be charged with a DWI, which constitutes a Class B misdemeanor. You can be charged with a DWI, regardless of whether you are under or over 21.
